Terms of Use

Please carefully read the following agreement. These Terms of Use are necessary to help protect both you and Nissan Canada. In addition to the Code of Conduct you must follow when posting materials on the site, we explain below the various laws that help protect our community against possible complaints. For example, you cannot use materials created by other people (copyright infringement), say false things about people (defamation), use another person's image without their consent (misappropriation of personality) or disclose someone else's personal information without their permission (invasion of privacy). It is very important that you understand what is considered acceptable behaviour and what is not, as you are agreeing to be responsible for any claims made by a third party that relate to any of the material you post on the site. In addition, you are agreeing that we have the right to forever use, edit and/or distribute any of the materials you post on the site that relate to Nissan and/or the Cube brand. Happy posting!

  1. Agreement
    Nissan Canada Inc. (hereinafter referred to as “us”, “we” or “Nissan”) welcomes you to cubecommunity.ca (the “Site”). By clicking “I Agree” below, you (the "User") signify that you have read, fully understand and agree to be legally bound by these Terms of Use ("Terms of Use" or "Agreement") and to comply with all applicable laws and regulations as they may change from time to time. IF YOU DO NOT ACCEPT AND AGREE TO BE BOUND BY AND COMPLY WITH ALL OF THESE TERMS OF USE, YOU ARE NOT PERMITTED TO ACCESS OR USE THE SITE. We suggest you print a copy of these Terms of Use for your records.

    We reserve the right, in our sole discretion, to change, add, or delete portions of these Terms of Use at any time without further notice or liability to you. If we do this, we will post the changes to these Terms of Use on the Site and will indicate at the top of this page the date these Terms of Use were last revised. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Use. It is your responsibility to regularly check the Site to determine if there have been any changes to these Terms of Use and to review such changes.

    You hereby acknowledge and agree that we reserve the right at any time to modify or discontinue the whole, or any part of, the Site, without notice to you, and that we will not be responsible or liable, directly or indirectly, to you or any other person for any loss or damage of any kind incurred as a result of any such modifications or discontinuance.

  2. Operators of the Site
    Nissan does not operate the Site. The Site is operated and managed by a select group of moderators (the “Moderator(s)”). If you encounter a problem while using the Site and/or have questions or concerns about the Site, please contact a Moderator at: info@cubecommunity.ca.

  3. User Code of Conduct
    The Site permits Users to upload, post or otherwise transmit content (the “User Content”).

    1. You hereby agree that you shall not use the Site to upload, post, communicate or otherwise transmit through, or to, the Site any User Content that:
      1. is defamatory, trade libelous, pornographic or obscene;
      2. contains, depicts, includes, discusses or involves, without limitation, any of the following:
        • Nudity;
        • Explicit, graphic or excessive sexual activity;
        • Crude, vulgar or offensive language and/or symbols;
        • Derogatory characterizations of any ethnic, racial, sexual or religious groups;
        • Content that endorses, condones or discusses any illegal, inappropriate or risky activity, behaviour or conduct;
        • Personal information of individuals, including without limitation, names and addresses (physical or e-mail);
        • Conduct or other activities in violation of these Terms of Use;
        • Commercial messages, comparisons or solicitations for products or services (other than those of Nissan);
        • Any identifiable third party products and/or trade-marks, brands or logos(other than those of Nissan);
        • Any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Moderators in their sole discretion.
      3. contains any reference to or likeness of any third parties, unless consent has been obtained from all such individuals (NOTE: if content contains reference to or likeness of any third parties who are under the age of majority in their jurisdiction of residence, then consent must also be obtained from any such persons parent or legal guardian);
      4. is disparaging or might be seen to be disparaging to Nissan, its products or promotions or anyone associated with same.;
      5. infringes or might infringe the intellectual property rights, privacy rights, rights of publicity, or other proprietary rights of others or give rise to any claims for payment whatsoever; or
      6. contains any viruses, trojan horses, time bombs, or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; and
    2. Further, you hereby agree that you shall not use the Site to:
      1. disrupt, place unreasonable burdens or excessive loads on, interfere with or attempt to gain unauthorized access to any portion of the Site;
      2. collect information about others without their consent; and
      3. upload, post, email, transmit or otherwise make available any content that you do not have the right to disclose or make available.

  4. Intellectual Property Rights (Re: Site Content) The Site consists of various graphics, texts, icons and buttons that have been provided by Nissan and/or others (e.g., site designers). All such content is owned by Nissan and/or the applicable third party. For greater certainty, Nissan, and applicable third parties, hold all right, title, and interest in and to any and all content provided by such parties for the Site, including, without limitation, all such information in text, graphical, video and audio formats, images, icons, designs, trade-marks, brand names and software (collectively, the “Content”). You hereby acknowledge that the Content is protected by copyright, trade-mark, and other applicable intellectual property laws.

    Your use of the Site does not grant or transfer to you any ownership or other rights in the Content, and except as expressly provided, nothing herein or within the Site shall be construed as conferring on you or any other person any license under any of Nissan’s or any third party’s intellectual property rights, including, without limitation, any right to copy, download, display, reproduce, distribute, modify, edit, alter or enhance any of the Content in any manner. Any rights not expressly granted to you in the Terms of Use are reserved by Nissan.

  5. License Granted to Nissan (Re: User Content)
    The Site permits you to upload, post or otherwise transmit content that you have created. By using the Site, you are giving Nissan permission to forever use any content you submit that relates to Nissan and/or the Cube brand. You hereby grant to Nissan a world-wide, perpetual, irrevocable, transferable, sub-licensable, royalty-free, non-exclusive, and unrestricted license to use, copy, reproduce, adapt, transmit, publicly display, distribute, translate and create compilations and derivative works from, any and all User Content (in any format or media) that is in any way related to Nissan and/or the Cube brand that you post on, upload or otherwise submit to, the Site.

  6. User Waivers and Representations (Re: User Content)
    You hereby acknowledge, agree, warrant and represent to Nissan that any and all User Content (in any format or media) you post on, upload to or otherwise submit to, the Site, is:

    1. is original to you and that you have all necessary rights in and to the User Content and all of its components (if applicable) to post, upload, or otherwise submit it to the Site; and
    2. is compliant with the WOMMA Ethical Blogger Contact Guidelines (available at: http://www.womma.org/).

  7. Indemnification by User
    You hereby agree to indemnify, defend and hold harmless Nissan Canada Inc. and its owners, affiliates, business partners, directors, officers, employees, agents and the Moderators from any loss, liability, claim, demand, damage or expense asserted by any third party relating in any way to your use of the Site or breach of these Terms of Use, including, without limitation, any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action.

  8. Duty of Moderators and Notice of Infringing User Content
    The Moderators and Nissan reserve the right, in their sole discretion, to modify, edit or remove any User Content, or to request a User to modify or edit his or her User Content, if a complaint or notice of allegedly infringing materials is received with respect to the User Content, or for any other reason. To complain about User Content and/or to provide notice of allegedly infringing materials on the Site, please contact a Moderator at: info@cubecommunity.ca. If the Moderator is unable to adequately address your concerns, then please contact us at: info@cubecommunity.ca.

  9. Disclaimer and Limitation of Liability
    THE SITE AND ALL INFORMATION CONTAINED ON OR ACCESSED FROM THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, AND WITHOUT ANY REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED. ALL CONDITIONS, REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE ARE HEREBY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW.

    WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, NISSAN MAKES NO REPRESENTATION OR WARRANTY THAT: (I) THE SITE WILL BE COMPATIBLE WITH YOUR COMPUTER AND SOFTWARE; (II) THE SITE WILL BE AVAILABLE OR WILL FUNCTION WITHOUT INTERRUPTION OR ERROR; (III) THE USE OF THE SITE, INCLUDING THE BROWSING AND DOWNLOADING OF ANY INFORMATION, WILL BE FREE OF ANY VIRUSES, TROJAN HORSES, WORMS OR OTHER DESTRUCTIVE OR DISRUPTIVE COMPONENTS; (IV) THE TRANSMISSION OF INFORMATION TO AND FROM THE SITE WILL BE SECURE; OR (V) THE USE OF THE SITE WILL NOT INFRINGE THE RIGHTS (INCLUDING INTELLECTUAL PROPERTY RIGHTS) OF ANY PERSON.

    NISSAN AND THE MODERATORS WILL NOT UNDER ANY CIRCUMSTANCES BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY DAMAGES WHATSOEVER ARISING FROM, CONNECTED WITH, OR RELATING TO THE SITE. YOU EXPRESSLY ACKNOWLEDGE THAT NISSAN HAS ENTERED INTO THIS AGREEMENT WITH YOU, AND MAKES THE SITE AVAILABLE TO YOU, IN RELIANCE UPON THE LIMITATIONS AND EXCLUSIONS OF LIABILITY AND THE DISCLAIMERS SET FORTH HEREIN, AND THAT THE SAME FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND NISSAN. YOU EXPRESSLY AGREE THAT THE LIMITATIONS AND EXCLUSIONS OF LIABILITY AND THE DISCLAIMERS SET FORTH HEREIN WILL SURVIVE, AND CONTINUE TO APPLY IN THE CASE OF A FUNDAMENTAL BREACH OR BREACHES, THE FAILURE OF ESSENTIAL PURPOSE OF CONTRACT, THE FAILURE OF ANY EXCLUSIVE REMEDY, OR TERMINATION OF THIS AGREEMENT.

  10. Electronic Transmissions The transmission of data or information over the Internet or other forms of networks is not secure, and is subject to possible loss, interception or alteration while in transit. We do not assume any liability for any damage you may experience or costs you may incur as a result of any electronic transmissions over the Internet or otherwise within the Site, such as transmissions involving the exchange of electronic messages of any kind (including those which may contain your personal information). In no event will the information you provide through the Site be deemed to be confidential, create any fiduciary obligations to you on our part, or result in any liability to you on our part in the event that such information is inadvertently released by us or accessed by third parties without your consent.

  11. Trade-Marks
    Without limitation, “Nissan”, “Cube” and other identifying marks of Nissan are and shall remain the trade-marks and trade-names and exclusive property of Nissan, and any use of such marks, other than use on the Site in relation to User Content, without our prior written consent is strictly prohibited. Other trade-marks that may appear on the Site are the property of their respective owners.

  12. Governing Law and Jurisdiction
    These Terms of Use, your use of the Site, and all related matters shall be governed solely by the laws of the Province of Ontario, Canada and the applicable federal laws of Canada, without regard to the conflicts of law provisions of any jurisdiction. You hereby irrevocably submit to the exclusive jurisdiction of the courts of the Province of Ontario in the City of Toronto in relation to all disputes arising from or related to this Agreement, your use of the Site and any related matters.

  13. Termination
    If you breach any provision of these Terms of Use, you may no longer use the Site. We may, in our sole discretion, change, suspend or terminate, temporarily or permanently, the Site or any part thereof or any of its features at any time, for any reason, without any notice or liability to you or any other person. If these Terms of Use or your permission to use the Site is terminated by us for any reason, the Agreement formed by your acceptance of these Terms of Use will nevertheless continue to apply and be binding upon you in respect of your prior use of the Site and anything relating to or arising from such use. If you are dissatisfied with the Site or with these Terms of Use, then your sole and exclusive remedy is to discontinue using the Site. The Disclaimer and Limitation of Liability, Intellectual Property and Indemnity provisions in this Agreement shall survive any termination of this Agreement.

  14. General
    If any provision of these Terms of Use is held invalid or unenforceable by any court having competent jurisdiction, such provision shall be enforced to the maximum extent permitted by law, and the remaining provisions of these Terms of Use shall continue in full force and effect. No failure to exercise or waiver of any provision of these Terms of Use shall be deemed a further or continuing waiver of such provision or any other provision of these Terms of Use. These Terms of Use are binding upon you, your heirs, executors, beneficiaries, successors and assigns and you may not assign this Agreement to any other party without our prior written consent, which consent may be withheld in our sole and absolute discretion.

Licence
This site permits you to upload, post or otherwise transmit content (the “User Content”). In addition to complying with and agreeing to the Terms of Use (available here), by clicking “I Agree” below, you hereby grant to Nissan Canada Inc. a world-wide, perpetual, irrevocable, transferable, sub-licensable, royalty-free, non-exclusive, and unrestricted license to use, copy, reproduce, adapt, transmit, publicly display, distribute, translate and create compilations and derivative works from, any and all User Content (in any format or media) that is in any way related to Nissan and/or the Cube brand that you post on, upload or otherwise submit to, cubecommunity.ca

Veuillez lire attentivement l’entente suivante. Les présentes Conditions d’utilisation sont nécessaires pour vous protéger vous-même et Nissan Canada. Outre le Code de conduite que vous devez suivre lorsque vous affichez du matériel sur le site, nous expliquons ci-dessous les différentes lois qui aident à protéger notre communauté contre des plaintes possibles. Par exemple, vous ne pouvez pas utiliser du matériel créé par d’autres personnes (atteinte au droit d’auteur), tenir des propos mensongers au sujet de certaines personnes (diffamation), utiliser l’image d’une autre personne sans son consentement (appropriation illicite de la personnalité) ou divulguer les renseignements personnels d’une autre personne sans sa permission (invasion de la vie privée).     Nissan ne fait pas fonctionner le Site. Le fonctionnement et la gestion du Site sont assurés par un groupe de choix de modérateurs (le(s) « Modérateur(s) »). Si vous éprouvez un problème en utilisant le Site et/ou avez des questions ou préoccupations au sujet du Site, veuillez communiquer avec un Modérateur à : info@cubecommunity.ca.

  3. Code de conduite de l’Utilisateur
    Le Site autorise les Utilisateurs à télécharger en amont, à afficher ou à transmettre autrement le contenu (le « Contenu de l’utilisateur »).

    1. Vous acceptez par les présentes que vous n’utiliserez pas le Site pour télécharger en amont, afficher, communiquer ou transmettre autrement par l’entremise, ou en direction, du Site tout Contenu de l’utilisateur qui :
      1. est diffamatoire sur le plan commercial, calomnieux, pornographique ou obscène;
      2. renferme, dépeint, inclut, commente ou concerne, sans restriction, aucun des points suivants :
        • de la nudité;
        • une activité sexuelle explicite, graphique ou abusive;
        • un langage et/ou des symboles crus, vulgaires ou offensifs;
        • des caractérisations dérogatoires de tout groupe ethnique, racial, sexuel ou religieux;
        • un contenu qui soutient, admet ou commente toute activité ou conduite ou tout comportement de nature illégale, inappropriée ou risquée;
        • des renseignements personnels sur des personnes incluant, mais sans s’y limiter, des noms et adresses (civiques ou courriels);
        • une conduite ou d’autres activités qui transgressent les présentes Conditions d’utilisation;
        • des messages commerciaux, comparaisons ou sollicitations à l’égard de produits ou services (autres que les produits de Nissan);
        • tous produits et/ou marques de commerce, marques ou logos (autres que ceux de Nissan) d’un tiers, pouvant être identifiés; et
        • tous autres contenus qui sont ou qui pourraient être considérés inappropriés, non convenables ou offensifs, tels qu’ils sont déterminés par les Modérateurs, et à leur seule discrétion.
      3. renferme toute référence ou ressemblance à l’égard de tous tiers, à moins qu’un consentement n’ait été obtenu de telles personnes (REMARQUE : si le contenu renferme une référence ou ressemblance à l’égard de tous tiers n’ayant pas atteint l’âge de la majorité établi dans leur territoire de résidence, alors un consentement doit aussi être obtenu de la part du parent ou tuteur légal de telles personnes);
      4. dénigre ou peut sembler dénigrer Nissan, ses produits, ses promotions ou toute personne associée à Nissan, ses produits ou ses promotions;
      5. transgresse ou peut transgresser les droits de propriété intellectuelle, les droits de la protection des renseignements personnels, les droits de la publicité, ou d’autres droits patrimoniaux d’autres personnes ou engendrer toute demande de paiement de quelque nature que ce soit; ou
      6. renferme tous virus, cheval de Troie, bombe à retardement, ou tout autre code, fichier ou programme informatiques conçus pour interrompre, détruire ou restreindre le bon fonctionnement de tous logiciel ou matériel informatiques ou matériel de télécommunications; et
    2. subséquemment, vous acceptez par les présentes que vous n’utiliserez pas le Site pour :
      1. perturber, mettre des fardeaux ou des charges excessives, entraver ou tenter d’obtenir un accès non autorisé à l’égard de toute portion du Site;
      2. rassembler des renseignements sur d’autres personnes sans leur consentement; et iii. télécharger, afficher, envoyer par courriel, transmettre ou rendre disponible autrement tout contenu que vous n’avez pas le droit de divulguer ou de rendre disponible.

  4. Droits de propriété intellectuelle (Objet : Contenu du Site)
    Le Site consiste en différents éléments graphiques, textes, icônes et boutons qui ont été fournis par Nissan et/ou des tiers (p. ex. des concepteurs de sites). La totalité d’un tel contenu est la propriété de Nissan et/ou du tiers concerné. Pour plus de certitude, Nissan et les tiers applicables conservent tous droit, titre et intérêt a l’égard de l’un et chacun des contenus fournis par de telles parties pour le Site incluant, sans restriction, de tels renseignements dans le texte, les éléments graphiques, et les formats vidéo et audio, les images, les icônes, les dessins, les marques de commerce, les noms de marques et le logiciel (collectivement appelés le « Contenu »). Vous reconnaissez par les présentes que le Contenu est protégé par les lois relatives au droit d’auteur, aux marques de commerce et aux autres droits sur la propriété intellectuelle applicables.

    Votre utilisation du Site ne vous accorde ou ne vous transfère pas tous droit de propriété ou autres droits à l’égard du Contenu et, sauf si cela est prévu expressément, rien aux présentes ou à l’intérieur du Site ne sera interprété comme vous conférant à vous ou à toute autre personne toute licence en vertu de tous droits sur la propriété intellectuelle de Nissan ou de tous tiers incluant, sans restriction, tous droits de copier, de télécharger en aval, d’afficher, de reproduire, de distribuer, de modifier, de réviser, de changer ou d’accroître tout élément du Contenu de quelque manière que ce soit. Tous droits qui ne vous sont pas expressément accordés dans les Conditions d’utilisation sont réservés par Nissan.

  5. Licence accordée à Nissan (Objet : Contenu de l’utilisateur)
    Le Site vous permet de télécharger en amont, d’afficher ou de transmettre autrement le contenu que vous avez créé. En utilisant le Site, vous donnez à Nissan la permission d’utiliser à perpétuité tout contenu que vous soumettez ayant trait à Nissan et/ou à la marque Cube (p. ex. un blogue au sujet du Cube ou une illustration incluant le Cube et/ou le logo de Nissan/du Cube).

    Par les présentes, vous accordez à Nissan une licence mondiale, perpétuelle, irrévocable, transférable, pouvant donner lieu à l’octroi d’une sous-licence, sans droits d’auteur, non exclusive et illimitée d’utiliser, de copier, de reproduire, d’adapter, de transmettre, d’afficher publiquement, de distribuer, de traduire et de créer des compilations et des œuvres dérivées à partir de tout Contenu de l’utilisateur (dans tous format ou média) qui sont de quelque façon liée à Nissan et/ou à la marque Cube que vous affichez, téléchargez en amont ou soumettez autrement au Site.

  6. Renonciations et Déclarations de l’Utilisateur (Objet : Contenu de l’utilisateur)
    Par les présentes, vous reconnaissez, acceptez, garantissez et déclarez à l’égard de Nissan que l’une et chacune des parties du Contenu de l’utilisateur (dans tous format ou média) que vous affichez ou téléchargez en amont sur le Site, ou soumettez autrement à son égard est :

    1. selon vous un original et que vous détenez tous les droits nécessaires à l’égard du Contenu de l’utilisateur et de tous ses éléments (le cas échéant) pour afficher ou télécharger en amont sur le Site, ou soumettre autrement à son égard; et
    2. est conforme aux Directives WOMMA (Ethical Blogger Contact Guidelines) (offertes à : http://www.womma.org/).

  7. Dédommagement par l’Utilisateur
    Par les présentes, vous acceptez de dédommager, de défendre et de dégager de toute responsabilité Nissan Canada Inc. et ses propriétaires, sociétés affiliées, partenaires commerciaux, administrateurs, représentants, employés, agents et les Modérateurs à l’égard de toutes perte, responsabilité, demande de règlement, revendication et de tous dommages ou coûts allégués par tout tiers lié de quelque façon que ce soit à votre utilisation du Site ou à la transgression des présentes Conditions d’utilisation incluant, sans restriction, l’une et chacune des demandes de règlement liées à des droits publicitaires, une diffamation, une invasion de la vie privée, la violation des droits d’auteur et des droits des marques de commerce ou à toute autre cause d’action liée à des droits de propriété intellectuelle.

  8. Fonctions des Modérateurs et Avis de transgression du Contenu de l’utilisateur
    Les Modérateurs et Nissan se réservent le droit, à leur seule discrétion, de modifier, réviser ou supprimer tout Contenu de l’utilisateur, ou de demander à un Utilisateur de modifier ou réviser son Contenu de l’utilisateur, si une plainte ou un avis relatifs à une transgression présumée du Matériel sont reçus à l’égard du Contenu de l’utilisateur, ou pour toute autre raison.

    Pour adresser une plainte au sujet du Contenu de l’utilisateur et/ou pour fournir un avis de transgression présumée du Matériel sur le Site, veuillez communiquer avec un Modérateur à : info@cubecommunity.ca. Si le Modérateur n’est pas en mesure de répondre entièrement à vos préoccupations, veuillez alors communiquer avec nous à : info@cubecommunity.ca.

  9. Exonération et limitation de responsabilité
    LE SITE ET TOUS LES RENSEIGNEMENTS QUI Y SONT CONTENUS OU À PARTIR DUQUEL CES RENSEIGNEMENTS SONT ACCESSIBLES, SONT FOURNIS « TELS QUELS », « SELON LEUR DISPONIBILITÉ » ET SANS AUCUNES DÉCLARATION, GARANTIE OU CONDITION DE TOUTE SORTE, EXPLICITE OU IMPLICITE. TOUTES CONDITIONS, DÉCLARATIONS ET GARANTIES, QU’ELLES SOIENT EXPLICITES, IMPLICITES, LÉGISLATIVES OU AUTRES SONT PAR LES PRÉSENTES DÉCLINÉES DANS TOUTE LA MESURE PERMISE PAR LA LOI. SANS LIMITER LA GÉNÉRALITÉ DE CE QUI PRÉCÈDE, NISSAN NE FAIT AUCUNE DÉCLARATION NI NE DONNE AUCUNE GARANTIE QUE : (I) LE SITE SERA COMPATIBLE AVEC VOS ORDINATEUR ET LOGICIEL; (II) LE SITE SERA DISPONIBLE OU EN FONCTION SANS INTERRUPTION OU ERREUR; (III) L’UTILISATION DU SITE, INCLUANT LA NAVIGATION ET LE TÉLÉCHARGEMENT EN AVAL DE TOUT RENSEIGNEMENT, SERONT EXEMPTS DE TOUS VIRUS, CHEVAL DE TROIE, VERS OU AUTRES ÉLÉMENTS DESTRUCTEURS OU PERTURBATEURS; (IV) LA TRANSMISSION DE RENSEIGNEMENTS EN DIRECTION ET EN PROVENANCE DU SITE SERA SÉCURITAIRE; OU (V) L’UTILISATION DU SITE NE TRANSGRESSERA PAS LES DROITS (INCLUANT LES DROITS DE PROPRIÉTÉ INTELLECTUELLE) DE TOUTE PERSONNE. DANS AUCUNE CIRCONSTANCE, NISSAN ET LES MODÉRATEURS SERONT RESPONSABLES ENVERS VOUS OU TOUT AUTRE PERSONNE À L’ÉGARD DE TOUS DOMMAGES DE QUELQUE NATURE QUE CE SOIT, ATTRIBUABLES, LIÉS OU AFFÉRENTS AU SITE. VOUS RECONNAISSEZ EXPRESSÉMENT QUE NISSAN A PRIS LA PRÉSENTE ENTENTE AVEC VOUS ET MET LE SITE À VOTRE DISPOSITION, SUR LA FOI DES RESTRICTIONS ET EXCLUSIONS DE RESPONSABILITÉ ET DES AVIS DE NON-RESPONSABILITÉ FORMULÉS AUX PRÉSENTES, ET QUE CES DERNIERS CONSTITUENT UNE PARTIE ESSENTIELLE DE LA NÉGOCIATION ENTRE VOUS ET NISSAN. VOUS ACCEPTEZ EXPRESSÉMENT QUE LES RESTRICTIONS ET EXCLUSIONS DE RESPONSABILITÉS ET LES AVIS DE NON-RESPONSABILITÉ FORMULÉS AUX PRÉSENTES SURVIVRONT ET CONTINUERONT DE S’APPLIQUER DANS LE CAS D’UNE OU DE TRANSGRESSIONS FONDAMENTALES), DE L’ÉCHEC D’UN OBJECTIF ESSENTIEL DU CONTRAT, DE L’ÉCHEC DE TOUT RECOURS EXCLUSIF, OU DE LA RÉSILIATION DE LA PRÉSENTE ENTENTE.

  10. Transmissions électroniques
    La transmission de données ou de renseignements sur Internet ou d’autres formes de réseaux n’est pas sécuritaire et est sujette à la perte, à l’interception ou à la modification possibles pendant leur transit. Nous n’assumons aucune responsabilité à l’égard de tout dommage que vous pourriez subir, ou coûts que vous pourriez engager à la suite de toute transmission électronique sur Internet ou autrement à l’intérieur du Site, telles des transmissions se rapportant à l’échange de messages électroniques de toutes sortes (incluant ceux qui peuvent renfermer vos renseignements personnels). En aucun cas les renseignements que vous fournissez par l’entremise du Site seront considérés confidentiels, créer à votre égard toute obligation fiduciaire de notre part, ou entraîner à votre égard toute responsabilité de notre part, si de tels renseignements nous sont divulgués par inadvertance ou que des tiers en ont obtenu l’accès sans votre consentement.

  11. Marques de commerce
    Sans restriction, « Nissan », « Cube » et d’autres marques identifiant Nissan sont et demeureront les marques de commerce, les noms commerciaux et la propriété exclusive de Nissan, et toute utilisation de telles marques, autre qu’une utilisation sur le Site en relation avec le Contenu de l’utilisateur, sans avoir obtenu au préalable notre consentement, est strictement interdite. Les autres marques de commerce pouvant apparaître sur le Site sont la propriété de leurs propriétaires respectifs.

  12. Loi et juridiction applicables
    Les présentes Conditions d’utilisation, votre utilisation du Site et toutes les questions y afférentes seront régies uniquement par les lois de la Province de l’Ontario, au Canada, et les lois fédérales du Canada qui s’appliquent, sans égard aux dispositions relatives aux conflits de lois de toute juridiction. Par les présentes, vous soumettez irrévocablement à la juridiction exclusive des tribunaux de la Province de l’Ontario, dans la Ville de Toronto, à l’égard de tous différends attribuables ou liés à la présente Entente, votre utilisation du Site et toutes questions y afférentes.

  13. Annulation
    Si vous contrevenez à toute disposition des présentes Conditions d’utilisation, vous ne pourrez plus utiliser le Site. Nous pouvons, à notre seule discrétion, modifier, suspendre ou terminer, temporairement ou en permanence, le Site ou toute partie de celui-ci, ou l’une ou plusieurs de ses caractéristiques en tout temps, pour toute raison, sans préavis ou responsabilité à votre égard ou à celui de toute autre personne. Si les présentes Conditions d’utilisation ou votre autorisation d’utiliser le Site sont annulées par nous, pour toute raison, l’Entente constituée par votre acceptation des présentes Conditions d’utilisation continuera néanmoins de s’appliquer et d’être obligatoire à votre égard en ce qui a trait à votre utilisation antérieure du Site et de tout élément lié ou attribuable à une telle utilisation. Aucune omission d’exécuter ou de renoncer d’exécuter toute disposition des présentes Conditions d’utilisation ne sera considérée une renonciation subséquente ou continue d’une telle disposition ou de toute autre disposition des présentes Conditions d’utilisation. Les présentes Conditions d’utilisation vous lient vous, vos héritiers, exécuteurs, bénéficiaires, successeurs et ayants droit, et vous ne pouvez céder la présente Entente à aucune autre partie sans obtenir au préalable notre consentement écrit, lequel consentement peut être refusé à notre seule et absolue discrétion.
